Come and hear about Manchester being chosen as one of three cities to trial an initiative called ‘The Capped Costs List’, which is designed to make it simpler and more cost effective for start-ups and SMEs to access the justice system.

Legal costs and the prospect of going to court can be daunting, but this event will explain how the new initiative will help streamline the process and cut costs for local businesses. 

The initiative will: 

  • streamline the procedures of the pilot courts
  • lower the costs of litigation
  • increase the certainty of costs exposure
  • speed up the resolution of claims

The event will also outline what support is available and what businesses can access under the new Business & Property Court.

One aim of the new court is to ensure cases are dealt with in the right location. The court encourages litigants to bring claims in the region and ensures adequate resources are available. No case is too large to be dealt with in the regional centres, as demonstrated by the commercial claim for £1 billion recently issued in Manchester and being dealt with by the judges here.

Another welcome development is the extension of the IPEC small claims track scheme to Manchester. This provides a forum with simpler procedures by which the most straightforward intellectual property claims, such as copyright, registered trade mark, unregistered design right and passing off claims, that have a low financial value can be decided. Its benefits are that it avoids the formalities of a traditional trial and the need to be legally represented. The parties are at risk of paying very limited costs only.
